Small Estate Affidavit

Oregon allows a procedure for handling "small estates." If an estate does not qualify for "small estate" status, a full probate is required. A small estate is an expediated and less expensive process. 

Qualifications for Small Estate Status: 
  1. No more than $75,000 in personal property; and
  2. No more than $200,000 in real property.

The procedure involves filing a Small Estate Affidavit. The Small Estate Affidavit cannot be filed until 30 days after death. The procedure is completed upon filing, however, the estate must wait four month before distributing assets to beneficiaries.
